If You Have Been Injured As A Result Of Medical Malpractice, Will You Be Eligible For A Lawsuit Loan? (Part 4)

In our previous articles, we have discussed the basic elements involved in bringing a medical malpractice claim. The first element we discussed was that the medical provider must have engaged in conduct that is not in keeping with the standards established for providers of that same specialty. The second element we discussed was that, irrespective of whether the provider adhered to the standards established, an individual must have suffered harm to be able to bring such a claim. Those two elements must be satisfied before an individual may possibly consider bringing the medical malpractice claim against the provider. Those elements must also be satisfied prior to obtaining a lawsuit loan to assist in pursuing such an action.

Nearly everybody has some thoughts of how they want to be spending their retirement years. A Debtor’s Guide to Bankruptcies

We all know people who claim to be legal experts but have no formal training. If such a person has told you that you should run up your credit cards before you file for bankruptcy because all your debt will be discharged anyway, please disregard their advice. If the Bankruptcy Court senses that you are acting in bad faith and taking advantage of the system then they will dismiss your claim. Therefore, to get the Bankruptcy Court to stay on your side and give you the benefit of the doubt, you need to make sure you have not used your credits cards within 90 days prior to filing for bankruptcy.

I always like to ask my clients, “Will your financial planner be willing to pay your long term care bills, will they have access to good quality Home Health Care Providers?” Many lawyers and advisors are now reluctant to recommend against Long Term Care Insurance for fear of law suits later on, from children, when hundreds of thousands of dollars were required to pay for their parents long term care bills. Planners who fail to recommend coverage are more times than not, unaware of the real RISK of needing care one day.
